Irrevocable Trusts

Trusts Designed to Protect Your Assets

An irrevocable trust is a trust that cannot be revoked or changed once it is established. Because of this, an irrevocable trust is an excellent option for people who may need to protect their assets from someone else in the future, such as an incapacitated child or grandchild. It is also an excellent option for people who want to make sure their assets are not subject to probate after their death.

An irrevocable trust is created by a grantor, who then places assets into the trust. The grantor then becomes the trustee of the trust and has full control over the assets within the trust. However, the trust itself is considered a separate entity from the grantor, and the grantor no longer has any control over the assets within the trust.

Because an irrevocable trust is considered a separate entity from the grantor, the assets within the trust are not subject to probate after the grantor's death. This means the assets will not be subject to probate fees or taxes, and the assets will not be available to creditors or other people who may make claims against the estate.

What Is a Revocable Trust?

A revocable trust is very similar to an irrevocable trust, but there is one key difference: a revocable trust can be revoked or changed at any time. This is the main difference between a revocable trust and a will, which cannot be changed once it has been created.

A revocable trust can be revoked at any time by the grantor, and the assets within the trust can be distributed to the beneficiaries as the grantor sees fit. However, once a trust has been revoked, it cannot be converted into an irrevocable trust.
